These Terms of Service ("Terms") govern your access to and use of AW AntiCheat, including the AW AntiCheat web panel (the "Panel") and the AW AntiCheat server-side resource for FiveM / GTA V roleplay servers (the "Resource") (together, the "Service"), operated by AW AntiCheat ("we", "us", "our", or the "Operator").

Please read these Terms carefully. They contain, among other things, a disclaimer of warranties, a limitation of liability, an indemnification obligation, a mandatory pre-suit dispute-resolution process, a class action waiver, and a governing-law and venue provision. If you do not agree to these Terms in their entirety, you must not access or use the Service.

1.Acceptance and Eligibility

By creating an account, signing in through Discord, purchasing a license, downloading or installing the Resource, submitting a support ticket, or otherwise accessing or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by every other document in the Agreement Set described below. Your agreement is formed at the earliest of any of those actions. The complete Agreement Set is published on our public site and presented at checkout, so that you can review every document before taking any of those actions. If you use the Service on behalf of a company, community, organization, or other legal entity, you represent and warrant that you have full authority to bind that entity, and "you" refers to both you personally and that entity, jointly and severally.

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, to create an account, make a purchase, or operate the Resource. By using the Service you represent and warrant that you meet this requirement, that you are not barred from receiving the Service under the laws of any applicable jurisdiction, and that all information you provide to us is accurate and current. We may refuse, suspend, or close any account that we determine, in our reasonable, good-faith discretion, does not satisfy these eligibility conditions.

2.The Agreement Set

These Terms do not stand alone. The following documents, each as amended from time to time, are incorporated into these Terms by reference and, together with these Terms, form a single, integrated agreement between you and the Operator (the "Agreement Set"): the Privacy Policy, the Refund & Billing Policy, the End User License Agreement, and the Acceptable Use Policy. All Agreement Set documents are published in the Panel and on publicly accessible pages of our site that do not require sign-in, and are presented for review at checkout. A reference in any of these documents to any other of them is a reference to the version currently published in the Panel and on our public site.

If there is a conflict between these Terms and another document in the Agreement Set, the document that deals more specifically with the subject matter of the conflict will control for that subject matter only: the End User License Agreement controls with respect to installation and use of the Resource, the Refund & Billing Policy controls with respect to payments and refunds, the Privacy Policy controls with respect to personal data handled by the Operator, and the Acceptable Use Policy controls with respect to prohibited and restricted conduct. In all other respects, these Terms control.

3.Description of the Service

The Service consists of two components. The first is the Panel: a web application through which you manage your account, purchase and manage licenses, edit your per-license anticheat configuration, review billing history, view validation and audit/activity logs, and open support tickets (with image attachments where offered). The second is the Resource: a server-side anticheat component that you download and install on your own FiveM game server and that operates under the license and configuration associated with your account.

Panel features made available to licensed customers may include, depending on your plan and our then-current offering:

  • Per-license anticheat configuration, including detections, punishment actions (such as warn, kick, or ban), bypass rules, whitelists, and Discord webhook destinations;
  • Plugins pushed by the Service to protected servers;
  • Support tickets with image attachments, billing and order history, validation logs (including server IP, hostname, license key attempted, and validation verdict), and audit/activity logs.

We do not promise that any particular feature will remain available, and nothing in these Terms or in any marketing material constitutes a commitment to provide any feature, detection method, or capability beyond what we actually make available at any given time. The Resource is deployed, configured, and operated by you on infrastructure you control; we do not operate your game server and we are not the operator of your community.

4.Accounts and Discord Sign-In

Sign-in to the Panel is available exclusively through Discord OAuth. There is no separate username-and-password login. When you authenticate, we receive your Discord ID, username, avatar, and email address from Discord, as further described in the Privacy Policy. You are responsible for maintaining the security of the Discord account you use to sign in, and you accept that anyone able to authenticate with that Discord account will have full access to your AW AntiCheat account, licenses, configurations, and secrets. All activity occurring under your account is deemed to be your activity, whether or not authorized by you, and you must notify us through a support ticket promptly upon becoming aware of any unauthorized use (including through the alternate-account pathway described in the Contact and Support section if you are locked out).

You may permit access to your account and license credentials by your own authorized staff who genuinely need that access to operate the licensed server. You remain fully responsible for everything those persons do, their actions are deemed your actions under the Agreement Set, and you must revoke their access promptly when they leave your organization or no longer need it. Selling, renting, lending, or transferring your account, or sharing it or its access with anyone outside your operating organization, remains strictly prohibited, as is using another person's account without our prior written consent. Our administrators may ban, suspend, or restrict any account at any time, in our reasonable, good-faith discretion, including where we suspect breach of the Agreement Set, fraud, abuse, or risk to the Service. If your Discord account becomes unavailable to you for any reason, we are under no obligation to migrate, merge, or recover your AW AntiCheat account, although we may choose to assist through the support-ticket process at our discretion.

5.Purchases, Billing, and Chargebacks

Licenses are purchased through the Panel using card or PayPal-style checkout. All charges are one-time charges; we do not operate auto-renewal, and no payment method is charged again without a new checkout initiated by you. Available plans include monthly, quarterly, yearly, and lifetime terms, and time-limited licenses may be renewed manually before or after expiry through a new purchase. "Lifetime" means the lifetime of the Service — that is, for as long as the Operator continues to operate the Service — and not the lifetime of the purchaser; a lifetime license confers no right to require that the Service continue to exist or be maintained. Prices are displayed at checkout, are subject to change at any time for future purchases, and may exclude taxes, duties, or payment-processor fees that you are responsible for where applicable.

Each order passes through states that may include pending, paid, failed, refunded, and granted. A license or entitlement is delivered only when the corresponding order reaches the granted state, and we may briefly withhold the granted state pending fraud review, payment confirmation, or verification. If an order reaches the paid state but we decline to grant the corresponding license (for example, following fraud or verification review), we will cancel the order and refund the amount paid, except where we determine, reasonably and in good faith, that the payment itself was fraudulent or was made with an unauthorized payment instrument.

Except as expressly provided in the Refund & Billing Policy, all purchases are final and non-refundable to the maximum extent permitted by applicable law. By completing checkout you expressly request immediate delivery and performance of the digital license and you acknowledge that, to the extent permitted by applicable law, you lose any statutory right of withdrawal or cancellation once the corresponding license is granted. All further matters relating to refunds, failed payments, and billing disputes are governed by the Refund & Billing Policy, which forms part of the Agreement Set.

We ask that you raise any billing concern with us first, through a support ticket in the Panel, before initiating a chargeback, payment reversal, or dispute with your card issuer or payment provider — this gives us the opportunity to resolve the matter directly and quickly. This request does not limit any rights you may have against your payment provider under applicable law or card-network rules. Upon receiving notice of a chargeback or payment dispute, we may suspend the affected license pending resolution of the dispute. If the dispute is resolved in your favor, or we accept it, we will restore the affected license or refund the charge, as appropriate.

If a chargeback or dispute is resolved against you, or we reasonably determine in good faith that it was fraudulent or abusive — for example, initiating a payment reversal while retaining and continuing to use the license, the Resource, or any deliverable of the Service — this constitutes a material breach of these Terms. In that case we may permanently ban the associated account and licenses, refuse future business, and pursue recovery of the disputed amount together with any chargeback fees, processor penalties, and reasonable costs of collection. Reinstatement in such cases, if offered at all, is at our sole discretion and may be conditioned on repayment of all such amounts.

6.One License, One Server

Each license activates exactly one (1) FiveM game server. A license binds automatically to the first server that successfully validates with it, and remains bound to that server until it is unbound. Unbind and rebind functionality exists solely to allow you to migrate your license to a replacement server for the same community — for example, after a hosting change or server rebuild. Using unbind/rebind to operate the Resource on more than one server, whether concurrently or in rotation, or to provide protection to servers you do not operate, is a material breach of these Terms. We may impose rebind cooldowns and frequency limits at any time, and may review, rate-limit, or refuse unbind/rebind operations where we reasonably suspect key sharing, circumvention of the one-license-one-server model, or any other breach of the Agreement Set.

Each license consists of a license key together with an HMAC signing secret, both of which are placed in your server's server.cfg. These credentials are confidential. You must treat the license key and signing secret with at least the degree of care you apply to your own most sensitive credentials, must restrict access to them to authorized staff who genuinely need them to operate your server, and must not publish, share, sell, lease, sublicense, or otherwise disclose them to any other third party. Any leak, sale, sharing, or attempted multi-server use of a license or its credentials is a material breach of these Terms and grounds for immediate revocation of the license and termination of your account without refund. If you believe your credentials have been compromised, you must notify us promptly through a support ticket so the license can be re-secured.

7.Validation and Signed Verdicts

The Resource periodically revalidates with our servers — approximately every five (5) minutes — and receives configuration data and verdicts that are HMAC-signed to prevent tampering. Continuous or intermittent connectivity between your server and our validation infrastructure is therefore required for the Resource to operate as intended, and you are responsible for ensuring that your server can reach our infrastructure. We record validation activity, including the server IP address, hostname, license key attempted, and the resulting verdict, and make relevant validation logs visible in the Panel.

The Resource's behavior while validation is unavailable is described in the applicable documentation and may include reduced or suspended protection. You are responsible for your own contingency configuration and for moderating your server during any loss of connectivity, whatever its cause. Interruptions of validation, and any resulting protection gaps or Resource behavior, are subject to the Disclaimers and Limitation of Liability sections of these Terms, do not constitute a breach by us, and do not entitle you to any refund except as expressly provided in the Refund & Billing Policy.

We may issue, withhold, or revoke validation verdicts, exercising our discretion reasonably and in good faith, including to enforce license binding, to respond to suspected fraud, key leakage, tampering, or abuse, and to protect the integrity of the Service. You must not intercept, modify, replay, forge, spoof, cache beyond intended lifetimes, or otherwise interfere with validation traffic, signed configurations, or signed verdicts, and you must not attempt to operate the Resource in a manner that evades or simulates validation. Signing secrets, webhook URLs, and API keys are held server-side only and are never sent to game clients by design; you must not take any action that exposes them to clients or to third parties. Any interference with the validation or signing mechanisms is a material breach entitling us to immediate termination without refund.

8.Your Configuration, Your Responsibility

You — not the Operator — decide how the Resource behaves on your server. Through the Panel you select which detections are active, which punishments (warn, kick, or ban) apply, which players are whitelisted, which bypass rules exist, and which Discord webhooks receive detection, ban, and join logs in your own Discord servers. You alone are responsible for every consequence of those choices, including any warning, kick, ban, or other action applied to any player of your server, whether resulting from a correct detection, a false positive, a misconfiguration, or a bypass or whitelist rule you created or failed to create.

Certain features are optional and are enabled only by your configuration, including chat-author verification; a Discord account-age check (decoded locally from the Discord snowflake ID, without any API call); a Steam account-age check performed server-side using your own Steam Web API key; and an on-screen OCR layer that captures the player's game frame locally on the player's machine, reads visible text locally (Tesseract in NUI), matches it against a cheat-menu watermark list, and then discards the text, with only a match/no-match flag ever leaving the player's machine. If you enable any optional feature, you are solely responsible for determining that its use is lawful in the jurisdictions relevant to you and your players, for providing any notices to and obtaining any consents from your players that applicable law requires, and for the accuracy and lawful use of any third-party credentials (such as your Steam Web API key) that you supply.

As between you and the Operator, you are the sole data controller (or the equivalent role under applicable law) of player data processed by the Resource on your game server — including player identifiers (such as Rockstar license, Discord ID, Steam ID, Xbox Live, Microsoft Live, FiveM account, and IP address), hardware tokens, player names, detection events, and ban records. That player data is processed on your infrastructure under your deployment and configuration decisions; the Operator does not receive it in the ordinary operation of the Service and is neither a controller nor a processor of it. To the extent the Operator processes personal data in operating the Panel and validation — such as your Discord account data and validation logs — the Privacy Policy governs, and where mandatory applicable law requires a data processing agreement, the data-processing terms set out in the Privacy Policy apply. You warrant that you have a lawful basis for all player-data processing you enable and that you provide your players with all legally required disclosures, expressly including with respect to the optional OCR layer, IP addresses, and hardware tokens. Webhook destinations you configure belong to you; once logs are delivered to your Discord servers, their further handling, retention, and exposure are entirely your responsibility.

9.Your Content

You retain ownership of the content you submit to or create within the Service, including your anticheat configurations, whitelists, bypass rules, ban records you create, webhook settings, and support-ticket messages and image attachments (collectively, "Your Content"). You grant the Operator a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display Your Content as reasonably necessary to operate, secure, maintain, and improve the Service, to deliver signed configurations to your server, and to provide support, for as long as Your Content remains in the Service plus any period required for backups, security, and legal compliance.

You represent and warrant that you have all rights necessary to submit Your Content, that it is lawful, and that it does not infringe any third party's rights or contain malicious, deceptive, or unlawful material. We may remove, disable, or refuse any of Your Content that we reasonably believe violates the Agreement Set or applicable law, without liability to you. We have no obligation to store or retain Your Content after termination of your account, except as described in the Privacy Policy.

10.Intellectual Property and License Grant

The Service, including the Panel, the Resource, all plugins, detection logic, watermark and signature lists, signing and validation mechanisms, documentation, branding, and all related software, designs, and content, together with all intellectual property rights therein, are and remain the exclusive property of the Operator and its licensors. Nothing in the Agreement Set transfers any ownership interest to you. All rights not expressly granted are reserved.

Subject to your continued compliance with the Agreement Set and payment of all applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Resource on the single FiveM server bound to your license, and to access and use the Panel, in each case solely for operating anticheat protection on your own server and for no other purpose. You may not resell, redistribute, rent, lease, lend, sublicense, or provide the Service or the Resource to any third party, whether as a standalone product or as part of any hosting, "protection-as-a-service", or bundled offering, without our prior written consent. The scope of the license with respect to the Resource is further defined in the End User License Agreement, which controls in the event of any conflict on that subject. If you submit feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation.

11.Prohibited Conduct

In addition to the restrictions in the Acceptable Use Policy and the End User License Agreement, you must not, and must not permit or assist any third party to:

  • Reverse engineer, decompile, disassemble, deobfuscate, dump, or otherwise attempt to derive the source code, algorithms, detection logic, or signing mechanisms of the Resource, the Panel, or any plugin, except to the limited extent such a restriction is prohibited by mandatory applicable law;
  • Modify, patch, hook, tamper with, or create derivative works of the Resource or its communications, or interfere with, forge, replay, or suppress validation traffic, signed configurations, or signed verdicts;
  • Leak, publish, share, sell, or distribute the Resource, any plugin, any license key, signing secret, webhook URL, API key, or any non-public material obtained through the Service, or use any leaked or cracked copy of the Resource;
  • Publicly disclose, publish, or share non-public information about the Service's detection behavior, watermark or signature lists, validation protocol, or any technique for evading, degrading, or defeating detection, whether that information was obtained through use, testing, or observation of the Service;
  • Circumvent or attempt to circumvent the one-license-one-server model, license binding, account bans, or any technical or contractual restriction of the Service;
  • Use the Service, or knowledge gained from it, to build, train, test, or improve any competing anticheat, cheat, cheat loader, bypass, or detection-evasion product;
  • Probe, scan, overload, disrupt, or attack our infrastructure, or access any account, data, or system without authorization;
  • Engage in fraud, payment abuse, or misrepresentation, including purchases with unauthorized payment instruments; or
  • Abuse the support-ticket system, including through harassment, spam, or the submission of unlawful or malicious content or attachments.

We may investigate any suspected violation and may determine, in our reasonable, good-faith discretion, whether a violation has occurred and what remedy applies, including warning, feature restriction, license revocation, account ban, or termination without refund, in addition to any other rights and remedies available to us at law or in equity. You acknowledge that violations of this section may cause us irreparable harm for which damages are an inadequate remedy, and that we are entitled to seek injunctive relief without the requirement of posting a bond.

12.Suspension, Revocation, and Termination

We may suspend, restrict, revoke, or terminate your access to the Service, any license, or your account, in whole or in part, at any time and with immediate effect, where we determine in our reasonable, good-faith discretion that: (a) you have breached, or we reasonably suspect you have breached, any document in the Agreement Set; (b) you have engaged in suspected abuse, fraud, or misrepresentation; (c) a chargeback or payment dispute affecting your account remains unresolved or has been resolved against you; (d) you have engaged in reverse engineering, tampering, or leaking as described in these Terms; or (e) suspension or termination is reasonably necessary to protect the Service, our infrastructure, our other customers, or our legal position.

Where termination or revocation results from your breach of the Agreement Set, you are not entitled to any refund, credit, or compensation of any kind, including for unused license time and including for lifetime licenses. If we terminate or revoke your license other than for your breach and other than upon discontinuation of the Service, your sole and exclusive remedy is a pro-rata refund of the unused portion of the then-current prepaid term (and, for lifetime licenses, the amount, if any, specified in the Refund & Billing Policy), and no further liability attaches to us in connection with that termination.

Upon termination or revocation for any reason: your license(s) cease immediately; the Resource will cease to validate and you must cease all use of it and delete all copies in your possession or control; and your access to the Panel may be removed or restricted. You may stop using the Service and close your account at any time, but doing so does not entitle you to any refund except as expressly provided in the Refund & Billing Policy. Sections of these Terms that by their nature should survive termination — including intellectual property, confidentiality of credentials, disclaimers, limitation of liability, indemnification, governing law, and dispute provisions — survive any termination or expiry.

13.Changes to the Service and Pricing

The Service operates in an adversarial and rapidly changing environment, and we must be free to evolve it. We may, at any time and in our sole discretion, add, modify, replace, suspend, or discontinue any feature, detection, plugin, plan, or component of the Service, in whole or in part, with or without notice, and we may impose or adjust technical limits (such as validation frequency, log retention, or configuration options). We do not warrant that any feature available at the time of your purchase will remain available for the duration of your license, and no such change entitles you to a refund except as expressly provided in the Refund & Billing Policy.

We may change pricing at any time for future purchases and renewals; because all charges are one-time and there is no auto-renewal, a price change never results in an automatic charge to you. We may also discontinue the Service entirely. Holders of lifetime licenses acknowledge again that "lifetime" refers to the lifetime of the Service and that discontinuation of the Service ends all licenses, including lifetime licenses, without any obligation on our part beyond what mandatory applicable law requires.

14.Third-Party Services

The Service depends on and interoperates with services operated by third parties, including Discord (for OAuth sign-in and for webhooks that you configure), Steam and the Steam Web API (where you enable the Steam account-age check using your own API key), and the FiveM / Cfx.re platform and GTA V ecosystem on which your server runs. Your use of each third-party service is governed solely by that third party's own terms and policies, and you are responsible for complying with them, including Discord's and Valve's developer and API terms and the platform rules applicable to FiveM servers.

AW AntiCheat is an independent product. We are not affiliated with, endorsed by, or sponsored by Discord Inc., Valve Corporation, the Cfx.re/FiveM project, Take-Two Interactive, or Rockstar Games, and all third-party names and marks belong to their respective owners. We have no control over third-party services and are not responsible or liable for their availability, performance, changes, rate limits, or policies, or for any degradation or loss of Service functionality caused by them, including changes to Discord OAuth or webhooks, the Steam Web API, or the FiveM platform. Such third-party changes do not constitute a breach by us and do not entitle you to any refund except as expressly provided in the Refund & Billing Policy.

15.Disclaimers

THE SERVICE, INCLUDING THE PANEL, THE RESOURCE, ALL PLUGINS, SIGNED CONFIGURATION DATA, VERDICTS, AND LOGS, IS PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Anticheat is an inherently adversarial, probabilistic discipline. Without limiting the foregoing, we specifically do not warrant or guarantee: that the Resource will detect, prevent, or deter any particular cheat, cheat menu, exploit, or malicious actor, or all of them; that detections will be free of false positives, and you acknowledge that legitimate players may occasionally be flagged, warned, kicked, or banned as a result of detection heuristics or your configuration; that the Service will be uninterrupted, timely, secure, or error-free, and we provide no uptime or availability service-level agreement of any kind; or that validation, webhooks, plugins, or logs will operate without delay, loss, or failure. No advice or information obtained from us, whether through support tickets or otherwise, creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions, the above exclusions apply to the maximum extent permitted.

16.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE OPERATOR OR ITS OWNERS, PERSONNEL, CONTRACTORS, OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE, LOSS OF DATA, LOSS OF GOODWILL, LOSS OF PLAYERS OR MEMBERS, DAMAGE TO YOUR COMMUNITY OR REPUTATION, COST OF SUBSTITUTE SERVICES, OR SERVER DOWNTIME, ARISING OUT OF OR IN CONNECTION WITH THE AGREEMENT SET OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE AGREEMENT SET AND THE SERVICE, FROM ALL CLAIMS AND CAUSES OF ACTION COMBINED, SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU ACTUALLY PAID TO US FOR THE SPECIFIC LICENSE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT FIRST GIVING RISE TO THE CLAIM; AND (B) ONE HUNDRED UNITED STATES DOLLARS (USD 100). THE EXISTENCE OF MULTIPLE CLAIMS SHALL NOT ENLARGE THIS LIMIT.

You acknowledge that the pricing of the Service reflects this allocation of risk, that these limitations are an essential basis of the bargain between you and us, and that they apply even if any limited remedy fails of its essential purpose. Nothing in this section excludes or limits liability that cannot be excluded or limited under mandatory applicable law; in such cases, liability is limited to the minimum extent that law requires.

17.Indemnification

You agree to indemnify, defend, and hold harmless the Operator and its owners, personnel, contractors, and suppliers from and against any and all claims, demands, actions, investigations, damages, losses, liabilities, fines, penalties, costs, and expenses (including reasonable legal fees) brought by or arising from any third party — including any player of your server, any member of your community, any authority, or any other person — to the extent arising out of or relating to: (a) your game server(s), community, or any content or conduct on them; (b) your treatment of players, including any warning, kick, ban, or other punishment applied through or alongside the Resource, whether resulting from a correct detection, a false positive, or your configuration; (c) your configuration choices and enabled features, including punishments, bypass rules, whitelists, webhooks, the optional OCR layer, the Discord account-age check, and the Steam account-age check, and any failure by you to provide legally required notices to or obtain legally required consents from your players; (d) your handling of data delivered to destinations you control, including Discord webhook logs; (e) your breach of any document in the Agreement Set or of applicable law; and (f) your violation of any third party's rights or of any third-party service's terms. Your obligations under this section do not apply to the extent a claim arises from the Operator's own willful misconduct or fraud.

We reserve the right, at your reasonable expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to reasonably cooperate with our defense. You may not settle any indemnified claim in a manner that imposes any obligation or admission on us without our prior written consent. This section survives termination of the Agreement Set.

18.Amendments to These Terms

We may amend these Terms, and any other document in the Agreement Set, at any time. The current version of each document, together with its effective date, is published in the Panel and on our public site, and material changes will be announced via the Panel. Amendments that do not materially and adversely affect your existing rights take effect upon publication. Amendments that materially and adversely affect your existing rights take effect no earlier than thirty (30) days after they are announced via the Panel, except where an earlier effective date is required by applicable law or is strictly necessary to address security, fraud, or legal compliance. It is your responsibility to review the Agreement Set periodically.

No amendment retroactively eliminates the core entitlement you have already paid for — namely, the license bound to your server for the term you purchased — although we may continue to evolve features, detections, pricing for future purchases, and the technical operation of the Service as described in these Terms. Your acceptance of an amendment occurs through an affirmative act after its effective date: signing in to the Panel or making a new purchase, whichever occurs first. The Resource's automatic periodic revalidation with our servers does not, by itself, constitute acceptance. If you do not agree to an amendment, your sole and exclusive remedy is to stop using the Service and cease operating the Resource before the amendment takes effect; stopping use does not entitle you to any refund except as expressly provided in the Refund & Billing Policy.

19.Governing Law and Venue

These Terms and the entire Agreement Set, and any dispute, claim, or controversy arising out of or relating to them or to the Service (including non-contractual disputes and claims and questions of formation, validity, or termination), are governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia, without regard to conflict-of-laws principles that would apply the law of another jurisdiction.

The competent courts of Riyadh, Kingdom of Saudi Arabia, shall have exclusive jurisdiction and shall be the exclusive venue for all such disputes, and you irrevocably submit to the personal jurisdiction of those courts and waive any objection based on venue, forum non conveniens, or lack of personal jurisdiction. Notwithstanding the foregoing, we may seek injunctive or other equitable relief to protect our intellectual property, credentials, or the security of the Service in any court of competent jurisdiction. You are responsible for compliance with the laws of your own jurisdiction to the extent they apply to your use of the Service; local-law compliance for your server and community is your responsibility, not ours.

If you are a consumer in a jurisdiction whose mandatory law entitles you to bring proceedings in the courts of your place of residence or to the protection of mandatory local consumer law, nothing in this section deprives you of that entitlement. In all other cases, the governing law and exclusive venue stated above apply.

20.Dispute Resolution and Class Waiver

Before filing any claim against us in any forum, you must first open a support ticket in the Panel describing the dispute, the relief you seek, and the facts on which you rely, and allow sixty (60) days from submission for the parties to attempt in good faith to resolve the dispute informally. No claim may be filed before that sixty-day period expires, except where doing so is necessary to preserve a right under a mandatory statutory deadline. We will likewise attempt to raise any dispute with you through the Panel before commencing proceedings.

To the maximum extent permitted by applicable law, any claim arising out of or relating to the Agreement Set or the Service must be filed within twelve (12) months after the event first giving rise to the claim; any claim not filed within that period is permanently barred. This contractual limitation period does not apply where mandatory applicable law prescribes a longer period that cannot be shortened by agreement.

To the maximum extent enforceable under applicable law, you and the Operator each agree that any dispute arising out of or relating to the Agreement Set or the Service shall be brought and resolved only on an individual basis, in your or our individual capacity, and not as a plaintiff, claimant, or member of any class, collective, consolidated, joint, or representative proceeding. To the same extent, no court or adjudicator may consolidate the claims of multiple customers or preside over any form of class or representative proceeding involving the Service, and any relief awarded may benefit only the individual party pursuing it.

This class waiver is severable from, and independent of, the Governing Law and Venue section: a holding that the waiver is unenforceable does not affect the governing-law or venue provisions, and a holding that any governing-law or venue provision is unenforceable does not affect this waiver. If this waiver is held unenforceable with respect to a particular claim or form of relief, that claim or relief — and only that claim or relief — shall proceed on a non-class, non-representative basis to the extent required by law, and this waiver shall remain fully effective for all other claims and relief. This section survives termination of the Agreement Set.

21.General Provisions

The following provisions apply to these Terms and, unless a document states otherwise, to every document in the Agreement Set:

  • Entire agreement. The Agreement Set constitutes the entire agreement between you and the Operator regarding the Service and supersedes all prior or contemporaneous understandings, communications, representations, and agreements, whether written or oral, relating to its subject matter. You acknowledge that you have not relied on any statement not expressly set out in the Agreement Set.
  • Severability. If any provision of the Agreement Set is held invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible and, if necessary, reformed to best reflect the parties' intent, and the remaining provisions shall continue in full force and effect.
  • Survival. All provisions that by their nature should survive — including those addressing intellectual property, confidentiality of credentials, payment obligations, disclaimers, limitation of liability, indemnification, governing law and venue, and dispute resolution and the class waiver — survive termination or expiry of the Agreement Set.
  • No waiver. No failure or delay by the Operator in exercising any right or remedy operates as a waiver of it, and no single or partial exercise precludes any further exercise. Any waiver must be express and in writing issued by the Operator, and applies only to the specific instance stated.
  • Assignment. The Operator may assign, transfer, or delegate any of its rights and obligations under the Agreement Set, in whole or in part, at any time without notice or consent, including in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign, transfer, or delegate any of your rights or obligations, including any license, without our prior written consent, and any attempted assignment in violation of this provision is void.
  • Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, war, terrorism, civil disturbance, labor disputes, governmental action, internet or hosting failures, third-party platform changes or outages, and denial-of-service or other attacks.
  • No third-party beneficiaries; relationship. The Agreement Set does not confer any rights on any third party, including players of your server. Nothing in the Agreement Set creates any partnership, joint venture, agency, fiduciary, or employment relationship between you and the Operator.
  • Interpretation. Headings are for convenience only and do not affect interpretation. "Including" means "including without limitation". These Terms shall not be construed against the drafting party.

22.Contact and Support

The official channel for contacting us — for support, billing questions, legal notices, breach reports, security disclosures, or any other communication — is the Support (tickets) section inside the Panel dashboard. If you cannot access your account — for example, because the Discord account you use to sign in is compromised, lost, or banned — you may sign in with a different Discord account and open a support ticket identifying the affected account; we may require reasonable proof of ownership before acting on any request concerning that account. Communications sent through any other channel, including social media, Discord messages, or third-party platforms, are not official, may not be received or reviewed, and do not constitute notice to the Operator for any purpose under the Agreement Set.

A notice from you to us is deemed given when a support ticket containing it is successfully submitted. We respond to and resolve tickets at our discretion and do not guarantee any particular response or resolution time. Notices from us to you may be delivered through the Panel (including announcements and ticket responses) or to the email address associated with your Discord account, and are deemed received when made available through either channel.

The Terms of Service, Privacy Policy, Refund & Billing Policy, End User License Agreement, and Acceptable Use Policy form one agreement set — read them together. The English text is the governing version.
